1. Acceptance of Terms

By accessing or using the BoxAI platform at boxaiapp.com ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

BoxAI provides an AI-powered chatbot platform for businesses. The Service includes a SaaS dashboard for configuration, AI chatbot agents for WhatsApp, Telegram, Instagram, and web, order management, payment processing, CRM, analytics, and a mobile app for end customers.

3. Account Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.

4. Subscriptions & Billing

BoxAI offers subscription plans (Free, Starter, Professional, Business, Enterprise). Paid subscriptions are billed monthly or annually through Stripe. You agree to pay all applicable fees. Subscriptions renew automatically unless cancelled before the renewal date.

Usage limits (messages, orders, chatbots, team members) apply per plan. Exceeding limits may require an upgrade. We reserve the right to change pricing with 30 days notice.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Send spam, unsolicited messages, or harassing content through the chatbot
  • Attempt to gain unauthorized access to other accounts or systems
  • Reverse engineer, decompile, or disassemble the Service
  • Use the AI chatbot to generate harmful, misleading, or fraudulent content
  • Exceed rate limits or abuse the API in ways that degrade service for others
  • Resell or redistribute the Service without authorization

6. Your Content & Data

You retain ownership of all content you upload (product catalogs, images, business information). You grant BoxAI a license to use this content solely to provide the Service. You are responsible for ensuring you have the right to use any content you upload.

End customer data (conversations, orders, contact information) is processed on your behalf. You are the data controller under LGPD/GDPR, and BoxAI acts as a data processor.

7. AI-Generated Content

The AI chatbot generates responses based on your configuration and the Anthropic Claude API. While we strive for accuracy, AI-generated content may contain errors. You are responsible for reviewing and monitoring chatbot behavior. BoxAI is not liable for decisions made based on AI-generated responses.

8. Third-Party Integrations

The Service integrates with third-party services (WhatsApp/Meta, Google, Stripe, Mercado Pago, Anthropic). Your use of these integrations is subject to the respective third-party terms. BoxAI is not responsible for third-party service availability or changes.

9. Service Availability

We aim to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice. We are not liable for downtime caused by factors outside our control.

10. Limitation of Liability

To the maximum extent permitted by law, BoxAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

11. Termination

You may cancel your account at any time from the dashboard settings. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be retained for 30 days to allow export, then permanently deleted.

12. Governing Law

These Terms are governed by the laws of Brazil. Any disputes shall be resolved in the courts of Rio de Janeiro, RJ, Brazil.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on our platform. Continued use of the Service after changes constitutes acceptance.
